The Midpeninsula Community Media Center Inc. (“MCMC”) Privacy Policy describes how http://www.midpenmedia.org/ (the “Site”) treats personal information. The Site is run by MCMC.
YOUR USE OF THIS SITE, OR YOUR PROVISION TO US OF ANY PERSONAL INFORMATION CONSTITUTES YOUR AGREEMENT TO THESE TERMS AND ANY SUBSEQUENT CHANGES TO THESE TERMS (AS DESCRIBED BELOW); DO NOT USE THE SITE OR PROVIDE PERSONAL INFORMATION IF YOU DO NOT AGREE WITH ALL OF THESE TERMS.
Normal Browsing
As with many websites, MCMC maintains a server log, which automatically collects certain information when you browse, read, submit posts, or otherwise interact with the Site. This information includes, but is not limited to, your IP address, URL request, browser type, and date and time of your visit. We collect this information on an aggregate basis for internal management purposes.
We analyze traffic to the Site in various ways, and may use third party service providers to do so from time to time. We use this information to generate statistics and measure activity to improve the usefulness of the Site to our visitors. MCMC reserves the right to change analytic service providers at any time, with or without notice.
Unless you affirmatively provide additional information to us, MCMC does not collect or store personally identifiable information such as your name, mailing address, email address, or phone number.
Information You Provide
Users do not have to register for accounts in order to browse, read, submit comments, receive RSS feeds, or send links from the Site.
The Site requests personally identifiable information when a user creates an account. This information may include, but is not limited to, a user name, first and last name, e-mail address, employer, address, and website. A user must provide a user name, first and last name, and e-mail address to create an account. Providing additional information, including but not limited to address, employer, or website is optional. If you provide us feedback, respond to our surveys, post messages on the Site, or store content on your account, we will collect that information.
MCMC uses your information in the following ways: to facilitate the creation of and secure your account; identify you as a user in our system; provide improved administration of our Site and services; improve the quality of experience when you interact with our Site and services; send you a welcome e-mail to verify ownership of the e-mail address provided when your account was created; respond to your inquiries and requests; and to send you newsletters, surveys, offers, and other promotional materials related to our Site and services. MCMC does not use your e-mail address or other personal information to send commercial or marketing messages to you unless you’ve signed up to receive such messages. We may use your e-mail address for non-marketing or administrative purposes (such as notifying you of major Site changes or for customer service purposes).
We may create anonymous data records from your personal information by excluding information (such as your name and email address) that make the data personally identifiable to you. We use this anonymous data to analyze request and usage patterns so that we may enhance the content and navigation of our Site and services. We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties in our sole discretion.
Disclosure of Information
Affiliates and Acquisitions. Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future. We may share some or all of your personal information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company, business, or our assets, that company will possess the personal information collected by it and us and will assume the rights and obligations regarding your personal information as described in this Privacy Policy.
Other Disclosures. Regardless of any choices you make regarding your personal information (as described below), MCMC may disclose personal information in connection with any legal investigation and/or if it believes in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on MCMC; or (b) protect or defend the rights or property of MCMC or users of the Site or services. You expressly consent to the sharing of your personal information with as described above.
Third Party Service Providers. MCMC may share your personal information with third party service providers to: provide you with the Site and services; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to the MCMC. These third party service providers are required not to use your personal information other than to provide the services requested by MCMC. You expressly consent to the sharing of your personal information with our service providers as described above.
User-Generated Content. MCMC may publicly disclose your first and last name and email address in connection with your User-Generated Content. For example but without limitation, MCMC may list your first and last name and email address with your User-Generated Content on MCMC’s website or disclose your first and last name and email address to third parties that inquire about your User-Generated Content. You hereby consent to MCMC publicly disclosing your first and last name and email address in connection with your User-Generated Content.If you inquire about content, we will provide them your name and email address. When we do provide your name and email address to someone who requests it, we will tell the requester that they are not to use this information for marketing purposes.
Third Party Websites.
When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect personal information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.
Children’s Privacy
The Site’s content is intended for adults and we will not knowingly collect personal information from children under 13 years of age. If you are a parent or legal guardian of a child under age 13 who you believe has submitted personal information to the Site, please contact us immediately.
Users Outside of the United States
Your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personal information may be less stringent than the laws in your country.
Posting
Submitting a post or comment on the Site is a public action, and all content may be publicly visible, including the user name that you provide.
Any videos that you submit to the Site may be redistributed through the Internet and other media channels, and may be viewed by other Site users or the general public.
All content may be retained for restorative, archival, or research purposes. Editing or deleting content may alter the displayed state of the content, but will not permanently delete the content from the Site.
Security
The Site has commercially reasonable security measures in place to protect the loss, misuse and alteration of the information under our control. However, your secure use of the Site cannot be guaranteed by MCMC. MCMC shall not be responsible for any harm that you or any person may suffer as a result of a breach of security in respect to your use of the Site or any information you transmitted to the Site. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people.
Choices
We offer you choices regarding the collection, use, and sharing of your personal information. We may periodically send you free newsletters and e-mails that directly promote the use of our Site or services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below). Despite your indicated e-mail preferences, we may send you service related communication, including notices of any updates to our Terms of Use or Privacy Policy.
Changes to this Policy
This Privacy Policy is subject to occasional revision, and if we make any substantial changes in the way we use your personal information, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our Site. Any changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our Site. These changes will be effective immediately for new users of our Site. Please note that at all times you are responsible for updating your personal information to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. If you do not wish to permit changes in our use of your personal information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us.
